Construction Industry Arbitration Council (CIAC) is the Prime Arbitral Institution in India
focused on Construction & Related Disputes. It was inaugurated on 15th November, 2006 by the
then Hon’ble President of India, Dr. A. P. J. Abdul Kalam. CIAC is an independent, not for profit
institution headquartered in New Delhi to provide an Institutional Mechanism for Domestic and
International Arbitration for the resolution of disputes arising in the Construction and
Infrastructure Sector.
At the outset, let me introduce Construction Industry Arbitration Council (CIAC). The CIAC
has been established in India as a joint initiative between the Construction Industry
Development Council(CIDC) India and the Singapore International Arbitration Centre (SIAC) to
provide institutional mechanism dispute resolution similar to what is followed by SIAC and
International Court of Arbitration, The Hague. CIAC is the only Arbitral Institution in India to
focus mainly on Institutional mode of resolution of disputes. It is also the only Institution having
observer status with United Nations Commission on International Trade Law (UNCITRAL)
Working Group, which is concerned with framing of Arbitration Rules.
CIAC provide the forum and facilities for institutional arbitration. The institutional
arbitration process in the CIAC has various features like, Speed, Trained arbitrators, Transparent
process of appointment of arbitrators, Code of Ethics, Transparent management of arbitrator’s
fees, Monitor the progress of the case, Arranging logistics, facilities and services for hearing.
Main feature of the CIAC are that the making of award is time bound i.e. it is made within
30 days from the close of hearing. Further CIAC review award made by the Arbitral Tribunal
before issue.
Department of Justice, Ministry of Law & Justice, Govt. of India has approved & nominated
Construction Industry Arbitration Council (CIAC), as Nodal Agency for Disputes Resolution
through ADR Online or conventional mode vide its notifications dated 21st August, 2017,
wherein Govt. Departments/organisations have been advised to resolve their disputes through
ADR & not through litigation.
Govt. Departments as well as Private Sectors have empanelled CIAC as one of the Arbitral
Institutions for Resolution of Dispute through Institutional Arbitration.
The New Delhi International Arbitration Centre (NDIAC) Bill 2018 has been introduced in
Lok Sabha by Hon’ble Minister of State for Law and Justice and Corporate Affairs Shri PP
Chaudhary on Friday 5th January, 2018.
This Bill has been brought out with a view to promote institutional arbitration and to make
India a hub of international arbitration.
CIAC brings to you an opportunity to join its Panel of Arbitrators by attending the Empanelment
Arbitration Workshop proposed to be held on 5th – 7th July, 2018 at New Delhi and/ or “Under Grand Father
Category”. where as the “Under Grand Father Category” the applications would be examined & decided w.r.t
the policy of the CIAC.
Eligibility Criteria with requisite application form for empanelment of Arbitrators through Arbitrations
Workshop & “Under Grand Father Category” are annexed “A” & “B” respectively. Interested persons can
check up their eligibility before making their applications.
The need for settlement of disputes through arbitral process is increasing with more and more
Engineering, Construction and Infrastructure Projects happening all around and with the influx of more
MNCs bidding for such projects of high stakes. There is also increase in the number of corporates
entering the construction sectors. All this means more issues and disputes arising between the
contracting parties. Naturally there is an increasing demand for expert arbitrators, be it domestic or
international arbitration. Apart from ad hoc panel of arbitrators, there is an increased need for parties
opting for Institutional Arbitration in light of the NDIAC Bill 2018 referred above.
Construction Industry Arbitration Council (CIAC) offers well-structured Institutional Arbitration with
a high standard of professionalism and in that endeavour seeks to build a strong and well informed panel
of arbitrators.
Our Panel experts are people of high integrity and knowledge and are from varied fields like
judiciary, legal profession, engineering, management executives, financial specialists and so on to provide
a wider range of option for the parties.
With this in mind, CIAC had been periodically conducting workshops to offer special orientation
training on the various aspects of dispute resolution and arbitration to the aspiring panellists. The
workshops are handled by expert resource persons who are endowed with hands on experience in the
subject. The workshops are normally spread over a period of three days with different sessions focusing
on different nuances and aspects of dispute resolution and arbitration so that the participants when
empanelled with CIAC are considered as experts.
The need for arbitration is ever increasing and hence CIAC has planned to enlarge its panel of
arbitrators by conducting an exclusive Empanelment Arbitration Workshop. as referred above &
